Warrant of Execution

Your Creditors have obtained a County Court Judgement and now are seeking to obtain a Warrant of Execution.

A Warrant of Execution is an order to instruct a Bailiff to remove processions from your home, which will be sold at public auction to pay off your debt. It is important to be aware that the Bailiff can only seize property belonging to the debtor named on the Warrant of Execution.

Payment in full of the outstanding debt will halt any further action.

If you can not pay the debt in full you may be able to stop this the action by applying to the court to request that the Warrant of Execution is suspended. You will have to pay a fee to the court for this. The court will then inform your Creditor that you have filed to have the Warrant of Execution stopped. You will need to include a payment plan to pay your outstanding debt.

Your Creditor will be asked to agree to your offer of payment. They may accept your offer to pay but they could request a higher payment amount or even refuse to allow the Warrant of Execution to be suspended.

If your Creditor agrees to the suspension but not to your payment offer the courts will access your offer and make a decision on the information provided. They will then inform you of the amount to be paid and your Creditor will also be informed of the courts decision.
